The data processed depends on the form you use:

• Contact form: your name and surname, email address, subject and message content.
• Valuation request form: your name and surname, company name or title, phone number, email address, invoice and tax information, the address and type of the property and information relating to your request, and the contact details of the person who will show the property.
• Career application form: your name and surname, email address, phone number, the province where you are located, and information in your CV such as education and work experience.
• Information security records: technical access records kept on the server side to operate our site securely (for example, IP address and access time).
• Site usage data: only if you give consent in the cookie banner, statistical information such as page views, device, browser and approximate location, collected through cookies via Google Analytics. For details, please see the Cookie Policy.

• Receiving and evaluating your contact and valuation requests and responding to you
• Providing valuation and consultancy services, preparing quotations and invoicing
• Evaluating career applications and contacting you when a suitable position becomes available
• Fulfilling obligations arising from the legislation we are subject to (including the regulations of the Capital Markets Board of Türkiye (SPK) and the Banking Regulation and Supervision Agency (BDDK))
• Analysing site usage statistically and improving the site
• Ensuring information security and protecting our rights in possible legal disputes

Your data is processed on the following grounds set out in Article 5 of KVKK: it is directly related to the establishment or performance of a contract; it is necessary to fulfil our legal obligation; it is necessary for the establishment, exercise or protection of a right; and it is necessary for our legitimate interests, provided that your fundamental rights and freedoms are not harmed. For information you submit by ticking the consent box on our forms, your explicit consent is also obtained.

Your data may be transferred, to the extent required by the service and in accordance with the legislation, to authorised public institutions and organisations (SPK, BDDK, judicial authorities and similar bodies), to our business partners, and to the suppliers from whom we receive services such as email, hosting and site analytics (Google Analytics).

If our suppliers are located abroad, the transfer is carried out in line with the conditions set out in Article 9 of KVKK. Your data is not sold to third parties for advertising or marketing purposes.

Your data is collected electronically: data you submit yourself through the contact, valuation request and career forms on our website, and site usage data collected automatically through cookies.

Your personal data is retained for as long as the purpose of processing requires and for the retention periods set out in the relevant legislation. After these periods expire, your data is deleted, destroyed or anonymised.

Under Article 11 of KVKK, you have the following rights:

• To learn whether your personal data is being processed
• To request information if it has been processed
• To learn the purpose of processing and whether the data is used in line with that purpose
• To know the third parties to whom your data is transferred, in Türkiye or abroad
• To request correction if the data is incomplete or inaccurate
• To request deletion or destruction of the data under the conditions set out in the Law
• To request that correction, deletion and destruction operations be notified to the third parties to whom the data has been transferred
• To object to an outcome against you that arises from the analysis of the processed data exclusively by automated systems
• To claim compensation for damages if you suffer harm because the data was processed in breach of the Law

You can submit your requests in writing, together with documents verifying your identity, to our company address (Fabrikalar Mahallesi 3055 Sokak Eser İş Merkezi A Blok No:2/4 Kepez/ANTALYA), to our registered electronic mail (KEP) address (elmagayrimenkuldegerleme@hs01.kep.tr) or to info@elmagmd.com. Your application will be concluded free of charge within thirty days at the latest, depending on the nature of the request. If the process requires an additional cost, a fee may be charged at the rate set out in the tariff determined by the Personal Data Protection Board.
